Personal Data and Information Privacy Policy

Hello! Welcome to Derechos Digitales’ website. We hope you enjoy the content we have prepared for you. To learn more about who we are and what we do, please visit https://www.derechosdigitales.org/en/about-us/

Below, you will find our Personal Data and Information Privacy Policy, which applies to your use of this site and is intended to ensure a safe and transparent experience. If you have any questions, don’t hesitate to contact us at info@derechosdigitales.org.

Our commitment

Derechos Digitales is an organization that respects the rights of all individuals, including the privacy and personal data protection of those who interact with us. When you browse this website, you can count on our commitment to only process the information and personal data that is strictly necessary for specific purposes. We take care of it while it remains in our custody and completely and permanently delete it when it no longer serves that temporary purpose. As a general rule, the maximum retention period for this data will be three (3) months, except for anonymized statistical data, which may be kept for up to one (1) year.

How this policy works:

It is important to know that sending information over the internet is never entirely secure; therefore, it is the responsibility of each user to take necessary precautions. Once Derechos Digitales receives your information, such as browsing data or personal information voluntarily submitted through forms, it applies all reasonable security measures to protect it from unauthorized access, destruction, loss, alteration, disclosure, or any form of improper or unlawful processing, for as long as it remains in our custody and within the time limits described above. To this end, we implement technical security measures (such as data volatility or short-term retention and encryption of data in transit or at rest, when feasible) as well as administrative controls that limit the number of people within the organization who can access this information.

Only a small number of permanent members from our technical and legal teams will have access to any browsing information or personal data we may hold for the sole purpose of responding to specific user requests, if applicable.

Derechos Digitales only has access to a limited amount of browsing data. We do not use cookies or similar technologies to collect information on the identity, preferences, settings, or browsing activity of visitors to our site. The only exceptions are: 1) a session cookie used to identify your preferred language, which is temporary and expires when you close your browser; and 2) an anonymized content-tracking cookie that enables us to analyze visits to our site and understand which content attracts the most interest, without storing full IP addresses. In this case, please note that, even if requested, we wouldn’t be able to re-identify the user who accessed the site or the type of device used, as the information we hold is not linked to identifiable individuals, it is anonymized and aggregated, and used solely for internal measurement purposes.

Derechos Digitales does not use any technical measures — including cookies — to track individuals or identify them personally. Browsing this site will not, under any circumstances, involve the collection of sensitive data from our users. In particular, we will never request payment information through this channel.

In addition to the information collected while you browse this site, you may also voluntarily share personal data, for example, when signing up for an event or newsletter. The forms used for these purposes will only request the information necessary to organize that specific event or process, and will never ask for sensitive data or payment details. In the case of events, any data you provide will be deleted as soon as possible, with a maximum retention period of three (3) months, as mentioned above. In the case of the newsletter, only the information strictly necessary for its delivery (your name and email address) will be stored. This data will be used exclusively for that purpose and permanently deleted from our database if you unsubscribe. In both cases, only members of our technical, communications, and logistics teams will have access to this information, and the same security measures described above for browsing data will apply.

In the event of a significant security breach involving personal or browsing data stored on our servers that exceeds our ability to manage it and undermines our commitment to care, we will inform our community as soon as possible. We will always work to prevent unauthorized access by third parties and take responsibility for any consequences this may have for those affected. Our commitment includes managing that risk to the greatest extent reasonably possible.

Derechos Digitales will not share, communicate, transfer, or deliver users’ browsing information or personal data, whether for free or commercially, to anyone under any circumstances. Occasionally, third parties may have limited and temporary access to this data, but only if it is essential for the proper functioning of the site or due to an unavoidable legal requirement formally notified to the organization.

Users of this site have full rights as data subjects over their personal information. Under current Chilean law, they may request that Derechos Digitales confirm the existence of such data and grant access to data held by the organization. Users may also request the correction, updating, or deletion of their data, as well as information about who has access to it, whether in Chile or abroad, if applicable. For details about the types of information and data collected and stored by the organization, as well as the specific conditions applicable to each case, please refer to this policy. Accordingly, a request may receive a negative response if the organization does not have the requested information, either because it does not retain it or because it deletes it after a specific period.

To exercise any of these rights, please send an email to info@derechosdigitales.org.

This policy has been in effect since July 1, 2025. Derechos Digitales reserves the right to review and modify its terms and conditions at any time, and commits to promptly and publicly announcing any changes through its official channels.
